I have been looking at the draft Thai constitution, not to answer political questions, but to learn what the provisions mean and how the language of the constitution is used. I am concentrating on the Human Rights provisions. Below are several excerpts from the draft. Note that the provisions I am quoting do not represent the entire article but only reflect the first sentence or so. If questions arise within this forum, I will include additional material. One of the questions I have is the use of the word ย่อม in this context. For example, the first provision below states, "บุคคลย่อมเสมอกันในกฎหมายและได้รับความคุ้มครองตามกฎหมายเท่าเทียมกัน". Does the use of the word ย่อม mean "generally", "as a rule" which states the general principle, but which indicates that exceptions and limitations apply? (RID: "ย่อม ๑ คําช่วยกริยา แสดงว่าเป็นไปตามปรกติ ตามธรรมดา หรือ เป็นสามัญทั่ว ๆ ไป"). The translation below omits this interpretation.

Article 34. Persons are equal under the law and have equal protection under the law. Men and women have equal right and freedoms.

Article 35. Military personnel, police personnel, ranked civil servants or those with fixed salaries, and other state employees, have rights and freedoms under this constitution equal to all other individuals.
มาตรา ๓๖ บุคคลย่อมมีสิทธิและเสรีภาพในชีวิตและร่างกาย
Article 36. All persons shall have rights and freedom over their lives and bodies.
มาตรา ๓๗ บุคคลไม่ต้องรับโทษอาญา เว้นแต่ได้กระทำการอันกฎหมายที่ใช้อยู่ในเวลาที่กระทำนั้นบัญญัติเป็นความผิดและกำหนดโทษไว้
Article 37. No one shall be punished for a crime except for any action which violated the law in existence at the time such action was committed and a punishment was associated with the crime at that time. [prohibition against ex post facto laws]
และโทษที่จะลงแก่บุคคลนั้นจะหนักกว่าโทษที่กำหนดไว้ในกฎหมาย ที่ใช้อยู่ในเวลาที่กระทาความผิดมิได้
In addition, any punishment imposed on an individual shall not be greater than the punishment promulgated under the law at the time that the crime was committed.
มาตรา ๓๘ สิทธิของบุคคลในการสมรสและในครอบครัว ย่อมได้รับความคุ้มครอง
Article 38. Marriage and family rights of individuals are protected.
มาตรา ๓๙ บุคคลย่อมมีเสรีภาพในเคหสถาน และย่อมได้รับความคุ้มครองในการอยู่อาศัยและครอบครองเคหสถานโดยปกติสุข
Article 39. Persons shall enjoy freedom in their homes; shall receive protection in their dwellings; and shall take possession their homes in a peaceful manner.
มาตรา ๔๐ บุคคลย่อมมีเสรีภาพในการสื่อสารถึงกันโดยทางที่ชอบด้วยกฎหมาย
Article 40. Persons shall have the freedom of communications with each other in manner that is lawful.
มาตรา ๔๑ บุคคลย่อมมีเสรีภาพบริบูรณ์ในการถือศาสนา นิกายของศาสนา หรือลัทธินิยมในทางศาสนา และย่อมมีเสรีภาพในการปฏิบัติตาม ศาสนธรรม ศาสนบัญญัติ หรือปฏิบัติพิธีกรรมตามความเชื่อถือของตน เมื่อไม่เป็นปฏิปักษ์ต่อหน้าที่ของพลเมืองและไม่ขัดต่อความสงบเรียบร้อยหรือศีลธรรมอันดีของประชาชน
Article 41. Individuals shall have full freedom to believe in the religion [of their choice], the sect of religion [of their choice], or religious creed and shall have the freedom to practice in accordance with their religious values, religious activities, or to observe their customs in accordance with their beliefs,
[Alt 1] except when such [belief and practices] conflict with their responsibilities as citizens; or, create civil unrest; or, are contrary to the moral precepts of the general population.
[Alt 2] when such [beliefs and practices] do not conflict with their responsibilities as citizens; and, they do not create civil unrest or [are not contrary to] the moral precepts of the general population.
มาตรา ๔๒ บุคคลย่อมมีเสรีภาพในการแสดงความคิดเห็นและเผยแพร่ความคิดเห็นของตนโดยการพูด การเขียน การพิมพ์ การโฆษณา และการสื่อความหมายโดยวิธีอื่น
Article 42. Individuals have the freedom to express and disseminate their ideas through speech, writing, printing, publicizing, and any other means of distribution.
มาตรา ๔๓ สิทธิในทรัพย์สินย่อมได้รับความคุ้มครอง แต่การใช้ประโยชน์ในทรัพย์สินต้องคำนึงถึงประโยชน์สาธารณะด้วย ขอบเขตแห่งสิทธิและการจำกัดสิทธิเช่นว่านั้นย่อมเป็นไปตามที่กฎหมายบัญญัติ
Article 43. The rights of property shall be protected; however, the use of such property must take into consideration civic and community effects. The boundaries and limitations imposed on these rights shall be defined in accordance with applicable law.
มาตรา ๔๕ บุคคลซึ่งไม่มีสัญชาติไทยและมีถิ่นที่อยู่ในประเทศไทยจะมีสิทธิทางเศรษฐกิจ สังคม และวัฒนธรรมเพียงใด ให้เป็นไปตามที่กฎหมายบัญญัติหรือตามที่รัฐจัดให้
Article 45. Persons who are not Thai citizens and live within Thailand shall have such economic, social, and cultural rights as the law allows or as the government sets forth.
