มาตรา ๓๗ บุคคลไม่ต้องรับโทษอาญา เว้นแต่ได้กระทำการอันกฎหมายที่ใช้อยู่ในเวลาที่กระทำนั้นบัญญัติเป็นความผิดและกำหนดโทษไว้

"Article 37. No one shall be punished for a crime except for any action which violated the law in existence at the time such action was committed and a punishment was associated with the crime at that time. [prohibition against ex post facto laws]."

ขอบเขตแห่งสิทธิและการจำกัดสิทธิเช่นว่านั้นย่อมเป็นไปตามที่กฎหมายบัญญัติ

มาตรา ๔๕ บุคคลซึ่งไม่มีสัญชาติไทยและมีถิ่นที่อยู่ในประเทศไทยจะมีสิทธิทางเศรษฐกิจ สังคม และวัฒนธรรมเพียงใด ให้เป็นไปตามที่กฎหมายบัญญัติหรือตามที่รัฐจัดให้

"Article 45. Persons who are not Thai citizens and live within Thailand shall have such economic, social, and cultural rights as the law allows or as the government sets forth."
